Access to some sections of the site and/or any requests for information and services from users of the site may require them to enter personal data. The official Data Controller is Melina Colella who will ensure that the data is processed pursuant to Legislative Decree 196/2003 “Code on the Protection of Personal Data” (hereinafter referred to as the “Code”).
This information note aims to inform users on how News.Davines.Com will use their personal before they access the various sections of the site and before they enter their data. Therefore, users are required to read this information note before compiling the boxes in the various sections of the site.
The following information is always recorded and stored when a site is used: the name of the Internet Service Provider, the browser, the source web site and the pages requested. This information is used to compile statistics measuring the site’s use and further adapt the site to users’ requirements.
What the data will be used for
Depending on requirements as demonstrated from time to time by users accessing the various sections of the site, the personal data supplied by users when compiling the on-line modules may be used for the following purposes:
a) registration onto the site, required for access to particular sections of the site itself, or to deliver and manage the various services offered;
b) with the consent of the user and until such time the consent is revoked, carry out marketing activities (such as, purely as an example and not limited to, sending promotional and advertising material, carrying out research on registered users so that News.Davines.Com may improve the services and products it offers to its clients). This may also be carried out by e-mail, fax, MMM and SMS, with the specific consent of the user and until this consent is revoked;
c) send out a newsletter containing updates on news about the site;
d) respond to users’ requests concerning News.Davines.Com services (section “Contacts” in the site).
Registration by users onto the site is not required for the supply of some of the services offered by News.Davines.Com. However, in order to fulfil any users’ requests relating to these services, they will be asked to supply personal data to be used solely in relation to these services and only for the time required.
How personal data will be processed
Personal data will be processed mainly in electronic form using software strictly related to the uses outlined above.
The supply of personal data by users
Services cannot be supplied where specific data required for the performance of these services is missing or only partially or incorrectly completed.
Categories of personal data used
As well as personal data supplied directly by users (such as name, surname, postal and e-mail address,etc.) during connection to the site, the computer systems and software procedures that operate the site itself indirectly acquire certain personal data whose transmission is implicit during the use of the Internet communication protocols. This data is used only to compile anonymous statistical surveys.
Categories of persons who may become aware of users’ personal data
Personal data may be brought to the attention of employees or person working with the Data Controller who, operating under the direct authority of the Data Controller, are nominated as data processing managers pursuant to Articles 29 and 30 of the Code and who will be suitably trained for the task; managers nominated by the Data Controller will also be responsible for ensuring the training of staff in their employ or their collaborators.
Communication and circulation of users’ personal data
Personal data supplied directly by users when compiling on-line forms will not be communicated to third-parties or circulated.
Minors
Personal data relating to minors must be communicated by a parent or by a person who holds parental responsibility.

Right of access to personal data and other rights
Pursuant to Article 7 of the Code, the person concerned has the right to receive confirmation of the existence of personal data relating to him or her, even if this data has not yet been recorded, and for this data to be communicated to him or her in legible form.
The person concerned has the right to receive information on:
a) the origin of personal data;
b) the processing purposes and methods;
c) the logic applied if the data is processed using electronic tools;
d) the identity of the Data Controller, the managers and the designated representative in Italy, where applicable;
e) the persons or categories of persons to whom personal data may be disclosed or who could become aware of the data in their capacity as designated representative in Italy, managers or responsible persons.
The person concerned has the right to receive:
a) an update, correction or, if he or she requests it, addition to personal data;
b) request anonymity, the cancellation or a stop to the data being processed in breach of the law, including personal data that is not required to be stored for the purposes for which the data was initially collected or subsequently processed;
c) a declaration that the operations specified under letters a) and b) have been notified, including their contents, to the persons to whom personal data was disclosed or circulated, except when this is impossible or implies the use of means that are clearly disproportionate to rights being safeguarded.
The person concerned has the right to oppose, in total or in part:
a) the processing of his/her personal data for legitimate reasons, even if this data is relevant for purpose for which the data was collected;
b) the processing of personal data relating to him/her for the purpose of sending advertising material or selling products, carrying out market research or marketing communications. The person concerned may exercise the above rights directly or delegate, in writing, physical persons or associations to do so on his/her behalf.
How to exercise rights pursuant to Article 7 of the Code and obtain a list of persons responsible for data processing
The user may, at any time, exercise his or her rights pursuant to Article 7 of the Code as well as obtain a complete list of persons responsible for data processing by sending an e-mail to the Data Collector: m.colella@davines.it; or, a registered letter with confirmation of receipt to: Davines S. p.
